A new order has been issued that changes the procedures for releasing information in supervised release and pre-trial violation proceedings. General Order #129 replaces a previous order, General Order No. 110, and adds to existing federal and local rules related to criminal procedure.
The order gives guidance on when the U.S. Probation Office should provide information to parties at the start of a violation proceeding. It clarifies that this change only affects the timing of information release in support of an alleged violation. The order does not change either party’s right to request more disclosures under Federal Rule of Criminal Procedure 32.l(b)(2)(B) or as directed by the court.
